Kolkata, September 9, 2024 – The Supreme Court of India has issued a stern directive in the high-profile Kolkata rape-murder case, ordering doctors at RG Kar Medical College and Hospital to return to their duties by 5 pm tomorrow. Failure to comply may result in disciplinary action from the state government.
On September 8, protests erupted under the ‘Reclaim the Night’ campaign, with demonstrators demanding justice for the trainee doctor who was tragically raped and murdered at RG Kar Hospital on August 9. The Supreme Court, led by Chief Justice DY Chandrachud and Justices JB Pardiwala and Manoj Mishra, convened to address several critical issues: the status of the CBI investigation, the ongoing doctors’ strike, and the security arrangements for CISF jawans stationed at the hospital.
Key Court Findings and Orders
The court expressed concern over a 14-hour delay in registering the FIR and missing documents, which have raised questions about the investigation’s integrity. The CJI emphasized the urgency of presenting these missing documents to clarify the situation. Additionally, the court mandated that all CCTV footage related to the case be reviewed, noting discrepancies in the footage provided to the CBI.
Regarding the doctors’ strike, which has severely impacted patient care, the court instructed doctors to resume work immediately. The Chief Justice remarked that if doctors fail to comply by the specified deadline, the state government would be free to take action against them. The strike has already led to significant disruptions, with reports of 23 deaths and approximately 6 lakh people missing out on essential treatments.
Security and Facility Issues
The Supreme Court also addressed the security concerns for CISF jawans, ordering the state Home Secretary to provide adequate housing and security equipment for the personnel assigned to protect the hospital. This decision underscores the court’s commitment to ensuring safety for all involved.
Political and Administrative Reactions
The case has prompted significant political responses. West Bengal Governor CV Anand Bose has called for an emergency cabinet meeting, urging the Mamata Banerjee government to consider removing Police Commissioner Vineet Goyal due to widespread public dissatisfaction.
Upcoming Proceedings
The next hearing in the case is scheduled for September 17, where further updates and actions will be reviewed. The court’s orders highlight the need for immediate action and resolution in addressing both the immediate and systemic issues surrounding the case.
The Supreme Court’s involvement aims to restore order and ensure justice in this deeply troubling case, reflecting the urgency of addressing both the safety of medical professionals and the integrity of the investigative process.
